CTD Partner Program Terms & Conditions

These Terms and Conditions govern participation in the Central Tender Database (“CTD”) Partner Program.
By registering for or participating in the CTD Partner Program, you agree to be bound by these Terms and Conditions.
If you do not agree with these Terms, you should not register for or participate in the Partner Program.
1. Definitions
For purposes of these Terms:
“CTD”, “we”, “us” or “our” means Central Tender Database and/or the entity operating the Central Tender Database platform.
“Partner”, “you” or “your” means any individual or organisation approved to participate in the CTD Partner Program.
“Referral Link” means the unique tracking link provided to a Partner for promoting CTD.
“Referred Customer” means a new customer who accesses CTD through a Partner’s Referral Link and subsequently becomes a qualifying paying subscriber.
“Commission” means the amount payable to a Partner for a qualifying referral.
“Partner Account” means the account through which a Partner accesses the CTD Partner Program and monitors referral activity and commissions.
2. The CTD Partner Program
The CTD Partner Program allows approved Partners to promote Central Tender Database and earn commissions from qualifying new customers referred to CTD.
Participation in the Partner Program is subject to approval by CTD.
CTD reserves the right to approve, reject or terminate a Partner application or account at its discretion where permitted by law.
3. Eligibility
To participate in the Partner Program, you must:
- Provide accurate and complete registration information.
- Be legally capable of entering into an agreement.
- Use the Partner Program for legitimate promotional and referral purposes.
- Comply with these Terms and Conditions.
- Comply with all applicable laws and regulations.
If you register on behalf of a company or organisation, you confirm that you have authority to do so.
CTD may request additional information to verify a Partner’s identity or account details.
4. Partner Referral Link
After approval, a Partner may receive a unique Referral Link.
The Referral Link is intended to allow CTD to attribute qualifying referrals to the appropriate Partner.
Partners are responsible for using their own Referral Link when promoting CTD.
CTD cannot guarantee attribution where a customer:
- Does not use the Partner’s Referral Link;
- Uses another Partner’s Referral Link;
- Deletes or blocks relevant tracking technologies;
- Registers through another channel;
- Uses an invalid, altered or incorrectly formatted referral URL; or
- Otherwise cannot reasonably be attributed to the Partner.
CTD’s tracking records will be used as the primary basis for determining referral attribution.
5. Commission
The standard CTD Partner commission is:
R50 per qualifying new paying subscriber
A commission is only earned when a referred customer:
- Uses the Partner’s Referral Link;
- Registers with CTD;
- Purchases a qualifying CTD subscription;
- Successfully completes payment; and
- Remains a qualifying customer in accordance with these Terms.
A commission is not guaranteed merely because a person clicks a Referral Link or creates an account.
CTD reserves the right to introduce different commission structures for specific campaigns, partners, promotions or products.
Where a different commission is specifically agreed with a Partner in writing, that agreement will apply to the relevant referrals.
6. Qualifying Referrals
A referral must represent a genuine new customer.
The following generally do not qualify for commission:
- Self-referrals;
- Referrals created using fraudulent or misleading information;
- Duplicate customer accounts created to generate commissions;
- Artificial or automated referrals;
- Referrals generated through prohibited promotional methods;
- Transactions that are refunded, cancelled or reversed;
- Transactions associated with payment fraud or chargebacks;
- Transactions that otherwise violate these Terms.
CTD has the right to investigate questionable referrals before approving commissions.
7. Self-Referrals
Partners may not use their own Referral Link to purchase CTD subscriptions for themselves or to obtain commissions on their own purchases.
Partners may also not create accounts through associates, family members, employees or other persons for the purpose of circumventing this restriction.
Any commission generated through prohibited self-referral activity may be cancelled.
8. Refunds, Cancellations and Chargebacks
If a referred customer’s transaction is:
- Refunded;
- Cancelled;
- Reversed;
- Charged back;
- Identified as fraudulent; or
- Otherwise determined not to be a qualifying transaction,
CTD may cancel the associated commission.
If a commission has already been paid and the underlying transaction is subsequently reversed or refunded, CTD may deduct the corresponding amount from future commissions or request repayment where appropriate.
9. Subscription Renewals
Unless CTD expressly states otherwise in writing, the standard Partner Program commission applies to the initial qualifying subscription purchase only.
Partners do not automatically earn recurring commissions from subscription renewals.
CTD may introduce recurring commissions or other incentive structures in the future.
Any such change will apply according to the terms communicated for the relevant program or campaign.
10. Promotional Guidelines
Partners may promote CTD through legitimate channels, including:
- YouTube;
- TikTok;
- Facebook;
- LinkedIn;
- WhatsApp;
- Websites and blogs;
- Email marketing;
- Business communities;
- Training programmes;
- Direct referrals; and
- Other legitimate marketing channels.
Partners must ensure that promotional content is truthful, accurate and not misleading.
Partners must not make claims about CTD that CTD has not authorised or that are not supported by information published by CTD.
Partners must not represent themselves as employees, agents or official representatives of CTD unless expressly authorised to do so.
11. Prohibited Promotional Practices
Partners may not use the CTD Partner Program for:
- Spam;
- Fraudulent activity;
- Misleading advertising;
- Fake accounts;
- Automated or artificial traffic;
- Cookie stuffing or forced attribution;
- Misleading redirects;
- Phishing;
- Malware;
- Trademark abuse;
- False claims regarding CTD;
- Harassment;
- Illegal activities; or
- Any activity that could damage CTD’s reputation.
Partners must not make promises regarding guaranteed tender awards, guaranteed business opportunities, guaranteed income or guaranteed results on behalf of CTD.
12. Paid Advertising
Partners must not use CTD’s trademarks, brand assets or intellectual property in paid advertising campaigns without CTD’s prior written approval where such use could imply that the advertisement is operated or endorsed directly by CTD.
Partners must not purchase search engine keywords or advertisements designed to impersonate CTD or create confusion between the Partner and CTD.
CTD may provide additional advertising guidelines to Partners from time to time.
13. Brand and Intellectual Property
CTD retains all rights, title and interest in:
- The Central Tender Database name;
- CTD logos;
- CTD trademarks;
- Website content;
- Software;
- Graphics;
- Marketing materials; and
- Other intellectual property belonging to CTD.
Participation in the Partner Program does not transfer ownership of any CTD intellectual property to a Partner.
Partners may only use CTD marketing materials provided or approved by CTD and must stop using them when their participation ends.
14. Tracking and Reporting
CTD uses its affiliate tracking system to record referral activity and calculate commissions.
Partner dashboards may display information such as:
- Clicks;
- Referrals;
- Conversions;
- Commissions; and
- Payout information.
Tracking information may be delayed, adjusted or corrected where necessary.
In the event of a discrepancy between Partner-reported figures and CTD’s records, CTD’s system records will generally be used to determine the final referral and commission calculation, subject to applicable law.
15. Commission Approval
Commissions may initially appear as pending while CTD verifies that the underlying transaction qualifies.
CTD may delay commission approval where necessary to:
- Verify payment;
- Confirm subscription status;
- Investigate suspected fraud;
- Account for refunds or chargebacks; or
- Resolve attribution disputes.
A commission appearing in a Partner dashboard does not necessarily mean that the commission has been finally approved for payment.
16. Payouts
The current minimum payout threshold is:
R400
Once a Partner reaches the minimum payout threshold and the relevant commissions have been approved, the Partner may become eligible for payment according to CTD’s payout schedule and procedures.
CTD may require Partners to provide accurate payment and identification information before processing a payout.
Partners are responsible for ensuring that their payment information is correct.
CTD is not responsible for delays caused by incorrect or incomplete payment information supplied by a Partner.
17. Taxes
Partners are responsible for determining and complying with their own tax obligations arising from commissions received through the CTD Partner Program.
CTD does not provide tax, accounting or legal advice to Partners.
Where required by law, CTD may request information or documentation relating to tax or identity verification.
18. Privacy and Personal Information
CTD may process personal information relating to Partners and referrals for purposes including:
- Managing Partner accounts;
- Tracking referrals;
- Calculating commissions;
- Processing payouts;
- Preventing fraud;
- Providing support;
- Communicating with Partners; and
- Complying with legal obligations.
Personal information will be handled in accordance with CTD’s applicable Privacy Policy and applicable data protection legislation.
Partners must not unlawfully collect, use or disclose personal information belonging to referred customers.
19. Partner Responsibilities
Partners are responsible for:
- Maintaining accurate account information;
- Keeping login credentials secure;
- Using their Referral Link correctly;
- Ensuring their promotional activities comply with applicable laws;
- Ensuring claims made about CTD are accurate;
- Maintaining professional conduct; and
- Not engaging in activities that could harm CTD or its customers.
A Partner is responsible for activity conducted through their Partner Account unless they can demonstrate that the activity resulted from unauthorised access.
20. Suspension and Termination
CTD may suspend or terminate a Partner Account where CTD reasonably believes that a Partner:
- Breached these Terms;
- Engaged in fraudulent activity;
- Generated invalid referrals;
- Misused CTD’s brand;
- Engaged in prohibited promotional practices;
- Provided false information; or
- Engaged in conduct that may harm CTD, its customers or its reputation.
CTD may also terminate participation in the Partner Program where the program is discontinued or materially changed.
Upon termination, the Partner must stop using CTD Referral Links and CTD promotional materials.
21. Effect of Termination
Following termination:
- New referrals may no longer generate commissions.
- Access to the Partner Account may be restricted or removed.
- Unapproved commissions may be cancelled where they relate to invalid or prohibited activity.
- Legitimate approved commissions that became payable before termination may remain payable, subject to these Terms and any applicable verification requirements.
Termination does not remove any rights or obligations that arose before termination.
22. Changes to the Partner Program
CTD may modify the Partner Program from time to time, including:
- Commission amounts;
- Commission structures;
- Payout thresholds;
- Eligibility requirements;
- Promotional rules;
- Tracking methods; and
- Program features.
Material changes will be communicated through appropriate channels.
Unless otherwise stated, changes will apply to future qualifying referrals and transactions.
23. No Guarantee of Income
Participation in the CTD Partner Program does not guarantee that a Partner will earn any particular amount of money.
Partner earnings depend on factors including:
- Audience size;
- Referral activity;
- Conversion rates;
- Customer demand; and
- The number of qualifying paying subscribers generated.
Any examples of potential earnings displayed by CTD are illustrative only and are not guarantees of future income.
24. Relationship Between CTD and Partners
Participation in the Partner Program does not create:
- An employment relationship;
- A partnership in the legal sense;
- A joint venture;
- A franchise relationship; or
- An agency relationship,
unless expressly agreed otherwise in writing.
Partners are independent promoters of CTD and do not have authority to enter into contracts or make binding commitments on behalf of CTD.
25. Limitation of Liability
To the extent permitted by applicable law, CTD will not be responsible for indirect, incidental, special or consequential losses arising from participation in the Partner Program.
CTD does not guarantee uninterrupted availability of the Partner Program, affiliate dashboard, tracking system or website.
Technical interruptions, maintenance, third-party service failures and circumstances outside CTD’s reasonable control may affect tracking or availability.
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.
26. Indemnity
To the extent permitted by law, a Partner agrees to indemnify and hold CTD harmless from claims, losses, liabilities, damages or expenses arising from the Partner’s:
- Breach of these Terms;
- Unlawful promotional activities;
- Misrepresentation of CTD;
- Misuse of CTD intellectual property;
- Violation of applicable laws; or
- Fraudulent or abusive referral activity.
27. Governing Law
These Terms and the Partner’s participation in the CTD Partner Program shall be governed by the laws of the Republic of South Africa.
Any disputes shall be subject to the jurisdiction of the appropriate courts of South Africa.
