These Terms and Conditions (“Terms”) govern your access to and use of the Central Tender Database website, platform, subscription services, tender information, alerts, analytics, artificial intelligence tools, documents and related services.

By accessing or using CTD, creating an account, subscribing to a paid plan, downloading information, or otherwise using any part of the platform, you acknowledge that you have read, understood and agree to be bound by these Terms.

If you do not agree with these Terms, you should not use the CTD platform or its services.


1. DEFINITIONS

For purposes of these Terms:

“CTD”, “we”, “us” or “our” means Central Tender Database and its operating entity.

“Platform” means the Central Tender Database website, applications, dashboards, databases, tools, emails, alerts and associated services.

“User”, “you” or “your” means any person or organisation accessing or using the Platform.

“Tender Information” means tender notices, descriptions, references, closing dates, issuing authorities, categories, provinces, briefing information, contact information, documents, links and other procurement-related information displayed on CTD.

“Tender Intelligence” means information, statistics, analytics, estimates, scores, trends, competition indicators, AI-generated analysis and other information generated or displayed by CTD.

“Subscription” means any paid or free subscription, membership or access plan offered by CTD.

“Third-Party Source” means any government department, municipality, public entity, procurement platform, supplier, data provider or other external source from which information may originate.


2. PURPOSE OF CTD

Central Tender Database is a tender intelligence and information platform intended to help businesses and individuals discover, monitor and evaluate procurement opportunities.

CTD may provide:

  • Tender opportunities
  • Tender notices
  • Tender documents and links
  • Tender alerts
  • Search and filtering tools
  • Saved tender functionality
  • Tender activity statistics
  • Tender views and download statistics
  • Competition indicators
  • Tender matching
  • AI-generated tender intelligence
  • Estimated tender values
  • Other procurement-related information and tools

CTD is an information and intelligence platform.

CTD is not a government procurement authority, tender issuing authority, awarding authority, or government department, unless expressly stated otherwise.


3. IMPORTANT TENDER INFORMATION DISCLAIMER

3.1 Verify Before Acting

Tender information displayed on CTD may originate from government entities, public bodies, third-party sources, APIs, procurement systems and other external sources.

Although we make reasonable efforts to provide useful and accurate information, you must independently verify all tender information before taking any action, submitting a bid, spending money, purchasing goods, engaging suppliers or making a business decision.

The official tender notice and issuing authority remain the final source of truth.

3.2 Changes and Updates

Tender information can change after it has been published.

A tender may be:

  • Cancelled
  • Withdrawn

  • Suspended
  • Updated
  • Closed earlier or later than initially indicated

CTD cannot guarantee that every change will be reflected on the Platform immediately.

4. NO GUARANTEE OF TENDER SUCCESS

CTD does not guarantee that:

  • You will win a tender
  • You will be shortlisted
  • You will receive an invitation to bid
  • Your bid will be compliant
  • Your bid will be evaluated favourably
  • Your business will receive a contract
  • A tender opportunity will result in revenue
  • Any tender identified through CTD will be suitable for your business

Use of CTD does not create any relationship between CTD and the tender issuing authority.

CTD does not have the ability to influence the outcome of government or private procurement processes.

Any person claiming that CTD can guarantee a tender award, secure a government contract, influence an evaluation committee, or guarantee procurement business is acting without CTD’s authority.


5. TENDER INTELLIGENCE AND ANALYTICS

CTD may provide analytics designed to help users understand tender activity.

These may include:

  • Tender popularity
  • Estimated tender values

5.1 Intelligence Is Not Financial or Procurement Advice

Tender Intelligence should not be regarded as:

6. AI-GENERATED INFORMATION

CTD may use artificial intelligence and machine-learning technologies to analyse tender information and generate estimates, summaries, classifications, recommendations, scores or other insights.

AI-generated information may include:

  • Estimated tender values
  • Tender opportunity scores
  • Competition estimates
  • Tender summaries
  • Tender classifications
  • Potential supplier opportunities
  • Industry matching
  • Procurement insights
  • Automated recommendations

6.1 AI Estimates Are Estimates Only

Any AI-generated tender value or estimate displayed by CTD is an estimate and not a confirmed tender value.

For example, an estimate such as:

Estimated Tender Value: R2 million – R3 million

does not mean that the issuing authority has confirmed that the tender is worth R2 million to R3 million.

The actual value may be substantially different, unavailable, undisclosed or determined through the procurement process.

6.2 Do Not Make Decisions Solely on AI

Users must not rely solely on CTD’s AI-generated information when:

  • Deciding whether to bid
  • Determining pricing
  • Purchasing stock
  • Hiring employees
  • Obtaining financing
  • Entering contracts
  • Making investments
  • Committing business resources

Users should independently investigate the opportunity and, where appropriate, obtain professional advice.


7. TENDER DOCUMENTS

CTD may provide links to tender documents hosted on CTD or on third-party websites.

We do not guarantee that:

  • Every document is available
  • Documents will remain available
  • Documents are complete
  • Documents are the latest version
  • Documents have not been amended
  • Documents are free from errors
  • Documents are free from malicious software
  • Third-party document links will remain operational

Where possible, users should obtain and verify the latest documents directly from the official issuing authority.


8. TENDER DOCUMENT DOWNLOADS

Where CTD provides a download facility, access may be subject to account or subscription requirements.

CTD may:

  • Restrict downloads
  • Limit access
  • Remove documents
  • Replace documents
  • Change download requirements
  • Temporarily suspend downloads
  • Monitor download activity

Downloading a document from CTD does not mean that the document is necessarily the latest version.

Always check the official issuing authority for amendments and addenda.


9. SCAMS AND FRAUD WARNING

IMPORTANT: CTD WILL NEVER GUARANTEE THAT YOU WILL WIN A TENDER.

Users should be extremely cautious of individuals claiming to represent CTD who ask for money in exchange for:

  • Guaranteed tender awards
  • Government contracts
  • Insider tender information
  • Guaranteed supplier appointments
  • Guaranteed tender scores
  • Access to procurement officials
  • Influence over tender committees
  • “Winning tender” services
  • Fake tender documents
  • Payments to “release” a tender
  • Payments to “secure” a tender
  • Payments to “activate” a government contract

CTD does not authorise anyone to guarantee a tender award.

If you receive a suspicious communication claiming to represent CTD, verify it through the official CTD contact channels before making any payment or providing sensitive information.

Never make payment based solely on an unsolicited message.

Users should independently verify:

  • The identity of the sender
  • The organisation issuing the tender
  • The tender reference
  • Official contact information
  • Bank account details
  • Tender documents
  • Submission instructions

10. THIRD-PARTY INFORMATION

CTD may display information obtained from or linked to third-party websites and systems.

CTD does not control third-party websites and is not responsible for:

  • Their security
  • Their content
  • Their privacy practices
  • Their terms and conditions
  • Their changes or modifications

A link displayed on CTD does not necessarily constitute an endorsement or partnership.


11. USER ACCOUNTS

Certain CTD features may require an account.

You agree to:

  • Provide accurate information
  • Maintain accurate account information
  • Keep your login credentials confidential
  • Not share your account with unauthorised persons
  • Notify CTD of suspected unauthorised access
  • Use the Platform lawfully

You are responsible for activity occurring through your account where such activity results from your failure to adequately protect your credentials.


12. PROHIBITED USE

You may not use CTD to:

  • Reverse engineer the Platform

  • Attempt unauthorised access
  • Exploit security vulnerabilities
  • Reproduce CTD’s database commercially without permission
  • Resell CTD information without authorisation
  • Use CTD to facilitate unlawful activity

We reserve the right to suspend or terminate accounts involved in prohibited activity.


13. INTELLECTUAL PROPERTY

Unless otherwise stated, CTD’s:

  • Website design
  • Branding
  • Logos
  • Software
  • Database structure
  • Interface
  • Original content
  • Analytics systems
  • AI tools
  • Reports
  • Graphics
  • Marketing material
  • Compilation and organisation of information

are owned by or licensed to CTD and are protected by applicable intellectual-property laws.

You may use CTD information for your legitimate business and procurement activities subject to these Terms.

You may not reproduce, sell, redistribute, commercially exploit or systematically extract CTD’s database without written permission.


14. SUBSCRIPTIONS AND PAYMENTS

Certain CTD services require a paid subscription.

Subscription prices, features and billing periods will be displayed on the relevant subscription page.

By purchasing a subscription, you authorise the applicable payment provider to process payments according to the selected subscription.

CTD may change subscription prices and features from time to time, subject to applicable law and any notice requirements.


15. SUBSCRIPTION CANCELLATION

Users may cancel subscriptions in accordance with the cancellation process made available through CTD or the applicable payment platform.

Cancellation does not automatically entitle a user to a refund for services already provided, except where a refund is required by applicable law or expressly provided under the applicable subscription terms.

Where a subscription is cancelled, access to paid features may continue until the end of the applicable paid period, unless otherwise stated.


16. SERVICE AVAILABILITY

We aim to keep CTD available and operational but do not guarantee uninterrupted access.

The Platform may temporarily become unavailable because of:

  • Maintenance
  • Server failures
  • Internet outages
  • Hosting issues
  • API failures
  • Third-party service failures
  • Cybersecurity incidents
  • Software errors
  • Database problems
  • Government or third-party system changes
  • Force majeure events

CTD will take reasonable steps to restore services where reasonably possible.


17. ACCURACY OF INFORMATION

We endeavour to maintain a reliable tender database, but errors can occur.

Information may be:

  • Missing
  • Delayed
  • Incorrect
  • Incomplete
  • Duplicated
  • Outdated
  • Misclassified
  • Automatically generated
  • Imported from external systems

You must verify critical information against the official source before relying upon it.


18. NO PROFESSIONAL ADVICE

Information provided through CTD is general information and should not be treated as professional advice.

Where appropriate, users should obtain independent advice from qualified:

19. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, CTD will not be responsible for losses arising from your reliance on information provided through the Platform, including losses resulting from:

Nothing in these Terms is intended to exclude or limit liability where such exclusion or limitation is prohibited by applicable law.


20. USER RESPONSIBILITY

You acknowledge that you are ultimately responsible for your own tender decisions.

Before submitting any tender, you should confirm:

  1. The tender is still open.
  2. The closing date and time are correct.
  3. The tender documents are current.
  4. All addenda have been reviewed.
  5. All mandatory requirements have been satisfied.
  6. Any compulsory briefing has been attended.
  7. Your business meets the eligibility requirements.
  8. Your pricing is commercially appropriate.
  9. Your submission complies with the issuing authority’s requirements.
  10. The submission has been made through the correct official channel.

21. ALERTS AND NOTIFICATIONS

CTD may provide tender alerts by:

  • Other supported communication channels

Alerts are provided as a convenience.

We do not guarantee that every relevant tender will be delivered through an alert or that alerts will always be delivered before a tender closes.

Users remain responsible for monitoring relevant official procurement channels.


22. USER-GENERATED INFORMATION

If you submit information through CTD, including contact forms, enquiries, feedback or other submissions, you agree that:

  • The information you provide is accurate.
  • You have the right to provide it.
  • You will not submit unlawful or malicious content.
  • You will not impersonate another person or organisation.

You remain responsible for information you submit.


23. PRIVACY AND PERSONAL INFORMATION

CTD may collect and process personal information necessary to provide its services, manage accounts, process subscriptions, communicate with users, provide alerts and operate the Platform.

CTD will process personal information in accordance with applicable South African data-protection laws, including the Protection of Personal Information Act 4 of 2013 (POPIA) where applicable. POPIA establishes conditions for lawful processing of personal information by public and private bodies.

Our Privacy Policy should be read together with these Terms.

By using CTD, you acknowledge that your personal information may be processed for legitimate purposes connected with providing and improving our services, subject to applicable law.


24. SECURITY

We take reasonable measures to protect the Platform and user information.

However, no internet-based system can be guaranteed to be completely secure.

You acknowledge that:

  • Internet transmission involves risks.
  • No system can guarantee absolute security.
  • You should use strong passwords.
  • You should not share your login credentials.
  • You should report suspected security incidents promptly.

25. TERMINATION OR SUSPENSION

CTD may suspend or terminate access where reasonably necessary, including where a user:

  • Violates these Terms
  • Engages in fraudulent activity
  • Attempts to circumvent access restrictions
  • Misuses the Platform
  • Attacks or interferes with the Platform
  • Uses another person’s account without permission
  • Fails to make required payments
  • Engages in unlawful conduct

Where appropriate and legally required, CTD may provide notice before termination.


26. CHANGES TO THESE TERMS

CTD may update these Terms from time to time.

Updated Terms will be published on the Platform with a revised “Last Updated” date.

Continued use of CTD after updated Terms become effective constitutes acceptance of the updated Terms, subject to applicable law.


27. THIRD-PARTY SERVICES

CTD may rely on third-party services including:

  • Payment processors
  • Email providers
  • Hosting providers
  • Government APIs
  • Data providers
  • Analytics providers
  • Messaging services
  • Artificial intelligence providers

CTD is not responsible for failures caused solely by third-party systems outside our reasonable control.

CTD will not be responsible for failure or delay caused by circumstances beyond its reasonable control, including:

  • Telecommunications failures
  • Third-party infrastructure failures
  • Strikes

29. GOVERNING LAW

These Terms shall be governed by the laws of the Republic of South Africa.

Any dispute shall be dealt with in accordance with applicable South African law and the jurisdiction of the appropriate South African courts, subject to any mandatory rights or remedies available to consumers under applicable legislation.


30. SEVERABILITY

If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision shall be interpreted or modified to the extent necessary to make it enforceable where legally permissible.

The remaining provisions will continue to apply.


31. ENTIRE AGREEMENT

These Terms, together with CTD’s Privacy Policy, applicable subscription terms and any other policies expressly incorporated into them, constitute the agreement governing your use of the Platform, subject to applicable law.

Do not send payment or sensitive information to anyone claiming to represent CTD until you have independently verified their identity.

We will never guarantee that you will win a government tender or ask you to make a payment to influence a tender evaluation or award.

Never rely solely on CTD’s tender estimates, AI intelligence, competition indicators or other analytics when making a business decision.
